STRONG EVIDENCE OR BASE NEEDED FOR FILING RTI: HIGH COURT

Delhi (The Stellar News) Saksham Kalia: Citing the traffic of RTI’s for seeking Information from Government offices or authorities, High court commented that, appropriate evidence or reason should be required to file RTI. This comment came to reduce the pressure of unreasonable RTI’s in Government offices.

Petition was filed by Faridkot resident Satish Kumar as he had filed RTI and sought information from Punjab Government but he hasn’t got any reply. Then he appealed to State Information Commission but when he failed to get any help from there, he headed towards high court.

Hearing the petition, High Court asked Satish to give reason of filing RTI but he refused to answer citing the provision in RTI act. RTI gives freedom to petitioner to hide reason of filing RTI.

In a recent statement by Apex Court of India ordered that if the RTI filed is not related to public welfare then this will affect the privacy of third party. And the RTI act itself not allow to compromise with the privacy of any third party.
