Delhi (The Stellar News) Saksham Kalia: Most of us had listened or read about the quote, “Even leaves guilty but not be punished innocent”. This quote is the roots of Indian constitution but the case which we are discussing about is contradicting this statement. This story is about the life changing decision taken by Indian Court which wreaked the life of person name Vishnu. The Story of Vishnu who remained in jail for 20 years for the crime he never done.
Vishnu, a young man, who got imprisoned for 20 years under a false case. With this decision court not just physically imprisoned Vishnu but also mentally imprisoned his family.
Actual Story-
As per the statement of Vishnu, about 20 years ago he got involved in a small and a verbal fight on husbandry animals issue with other party. But due to the political connections of other party they filed a SC/ST case against Vishnu. Amid the illiteracy and poorness Vishnu didn’t able to arrange any lawyer from his side.
One day court arranged government lawyer and ordered lifetime imprisonment to Vishnu. In 2003, a woman also alleged that Vishnu raped her when he was going to farm field for work. Then, Lalitpur court taking Vishnu guilty announced 10 years imprisonment in rape case and lifetime jail in SC/ST case.
Case moved to Allahabad High Court-
After the Vishnu got imprisoned, his brother Mahadev came to met him and Vishnu himself gave his brother the number of Shweta Rana who was lawyer in Allahabad high court. Mahadev told media that he on the recommendation of Vishnu gave copy of Vishnu’s punishment orders to Lawyer Shweta.
When Media had words with lawyer Shweta Rana she said that, there were no evidences shown in court which can declare Vishnu as rapist. While she also added that the medical report of victim also can’t show Vishnu guilty. Victim also didn’t have any injuries.
What court said while releasing Vishnu-
After 20 years of Vishnu imprisonment, Honorable High court declared that the crime for which Vishnu was given lifetime imprisonment was false case. Condemning the lower court order, high court gave releasing orders of Vishnu. Court also ordered that, all cases in which the accused already go through with the respective punishment until the decision of court, all these cases should be settled as soon as possible. Such cases cannot be included in cases list.
Slow and Politically influenced System-
This case had exposed the whole judicial system where an innocent man got imprisoned for 20years without any crime. This case also show that how politically influenced people moulded judicial decisions as they want. Vishnu spent his half life in Agra Central Jail.
In this case the second factor which also meant to be responsible was delay in judicial proceedings. Why don’t court announced Vishnu innocent previously? If court had fast-tracked the proceeding than may be 20 years of Vishnu’s life cannot be wasted like this. Can someone bring back Vishnu’s 20years of life that he spent in Jail?
